These terms and conditions (hereinafter referred to as the "Terms") govern the mutual rights and obligations of the contracting parties
arising in connection with or on the basis of the purchase contract concluded between the Seller and the Buyer. These Terms apply to all
purchases of Goods from the Seller, whether made via the website buffer-tank.co.uk, by e-mail
communication or in any other way.
Article 1: Introductory provisions and definitions of terms
- Seller: Linszter Ltd, with registered office: 27 Old Gloucester street, London, WC1N 3AX, United Kingdom, registered in England and Wales
under Company Number: 08190915.
- Buyer: Any natural or legal person who orders Goods from the Seller.
- Goods: Products offered by the Seller. For example, buffer tanks, immersion heaters, expansion vessels and other accessories.
Article 2: Order and conclusion of the purchase contract

Placement of order: The Buyer may order the Goods by completing and submitting the order form on the
Place Order page or by sending the order details via a message on the
contact page.
- Order confirmation: After receiving the order, the Seller will confirm its receipt by e-mail and, if necessary, request additional
information. The purchase contract is concluded when the contracting parties reach a mutual agreement on the exact specification of the Goods and the price.
- Acceptance of an offer with a deviation: Acceptance of an offer by the Buyer with any addition or deviation is excluded. Any changes
to the Seller's binding offer must be expressly agreed to by the Seller in writing (by e-mail), otherwise they are not considered valid.
- Consent to the Terms: By sending the order, the Buyer confirms that he has read these Terms and agrees
with them in full. These Terms form an integral part of each purchase contract.
Article 3: Price and payment terms
- Payment methods:The Buyer may pay the purchase price in advance by bank transfer to the Seller's account.
- Deposit:
The Seller is entitled to request a deposit from the Buyer, especially in the case of Goods manufactured to order, of a non-standard type or for orders with
a higher total value.
The standard deposit amount is 20% of the total order price, unless otherwise agreed.
The deposit must be paid before the Goods are put into production.
If the Buyer fails to pay the required deposit within the agreed due date, the Seller is entitled to withdraw from the purchase contract.
- Contractual penalty(forfeiture of deposit):
In the event that the Buyer does not take over the properly and timely delivered Goods for no reason, or if he withdraws from the purchase contract after
its binding conclusion due to other than legal reasons, the Seller is entitled to keep the entire paid deposit as a contractual penalty for breach of the
Buyer's contractual obligations.
This does not affect the Seller's right to compensation for damages exceeding the amount of this contractual penalty.
Article 4: Terms of delivery
- Delivery time: Delivery time is subject to individual agreement.
The Seller will make every effort to deliver the Goods on the agreed date, but this date is approximate.
In the event of exceptional or unexpected circumstances, the Seller reserves the right not to deliver the Goods or to deliver them with delay.
The Seller is not responsible for any costs incurred by the Buyer due to a delay in delivery.
- Receipt of Goods:
The Buyer is obliged to thoroughly check the condition and integrity of the packaging upon receipt of the Goods.
Any detected damage or other obvious defects must be recorded by the Buyer immediately in the handover protocol or delivery note of the carrier and without
delay inform the Seller about it.
Later claims about obvious defects discovered during delivery may not be taken into account.
If the Buyer does not accept the Goods despite prior agreement with the delivery date, he is obliged to pay the Seller all costs associated with delivery.
- Proprietary right: Ownership of the Goods passes to the Buyer only upon full payment of the entire purchase price.
Article 5: Withdrawal from the contract
- Consumer's right of withdrawal:
The Buyer, who is a consumer, has the right to withdraw from the purchase contract without giving any reason within 14 days from the date of receipt of the
Goods.
This right does not apply to Goods that have been manufactured to the Buyer's specific requirements or customized.
- Terms of return of goods: For a successful return, the Goods must be:
- a) Unused, undamaged and in a resaleable condition.
- b) The buffer tank must be securely attached to the pallet and the accessories must be packed in their original packaging.
- c) Returned along with the original invoice.
- Right to refuse a return:
The Seller reserves the right to refuse to refund the purchase price or part thereof if the returned Goods do not meet the conditions specified in point 2 of
this article, in particular if they are damaged or in a condition that does not allow their further sale.
In such a case, the Goods may be sent back to the Buyer at his expense.
- Return costs and liability:
The costs associated with returning the Goods are borne in full by the Buyer.
Cash on delivery shipments will not be accepted by the Seller.
The Buyer acknowledges that the Seller is not responsible for loss or damage to the shipment during delivery back to the Seller.
When returning Goods of higher value, the Buyer is recommended to use delivery services that allow tracking of the shipment and its insurance.
- Return of goods from the promotional offer:
If the Buyer withdraws from the contract regarding Goods that were purchased as part of a promotional or discount offer (e.g. a volume discount), and as a
result of the partial return of the Goods, the conditions for applying the original discount are no longer met, the returned purchase price will be reduced
by the value of the discount provided.
If the Buyer returns all Goods purchased under such an offer, the full amount paid will be refunded.
- Procedure for withdrawing:
The Buyer is obliged to inform the Seller in advance of his intention to withdraw from the contract via the contact details provided on the website and follow
his instructions for returning the Goods.
After receiving and inspection of the returned Goods, the Buyer will be notified of the status of the returned Goods and the approval or rejection of the
refund request.
If approved, the Buyer will be refunded the purchase price (reduced by any shipping costs, if included in the price of the Goods) by bank transfer.
Article 6: Protection of personal data

The Seller processes the Buyer's personal data in accordance with applicable legal regulations, in particular Regulation (EU) 2016/679 (GDPR).

The Seller processes personal data provided by the Buyer via contacts, contact or order forms, for the purpose of concluding and fulfilling the purchase
contract.

In the event that the Buyer provides the Seller with personal data of third parties, the Buyer is obliged to properly inform these persons about the
processing of their personal data and to ensure the lawfulness of such provision. The Buyer is liable to the Seller for any damage that may arise as a
result of a breach of this obligation.

The Buyer has the right at any time to request information from the Seller about the processing of his/her personal data, to correct or delete it,
via the contact details provided on the Seller's website.
Article 7: Final provisions
- Information about the Goods:
The information, technical specifications and prices listed on the website are for informational purposes only.
The Seller tries to keep all data up to date, but reserves the right to change it and is not responsible for any inaccuracies.
In case of any uncertainty, we recommend that the Buyer verify the accuracy of the data by contacting the Seller directly.
- Governing law and jurisdiction:
All legal relationships arising from the purchase contract and these Terms are governed by the laws of Great Britain.
Any disputes that cannot be resolved amicably will be finally resolved by the competent courts of Great Britain.
- Severability clause:
If any provision of these Terms becomes invalid or ineffective, the validity and effectiveness of the other provisions shall remain unaffected.
- Change of Terms:
The Seller reserves the right to change these Terms.
The changed terms and conditions shall be effective on the date of their publication on the Seller's website.
The wording of the Terms effective at the time of its dispatch shall apply to a specific order.
